Flights that operate on a regular and pre-determined basis, with fixed routes and published timetables. They are often provided by commercial airlines that offer services to the general public.
The authorization request for scheduled air transport service operations consists of external procedures and ANAC procedures.
Registration of the company in the local commercial register (junta comercial) of the state (province) where the company intends to locate its branch.
The company must follow the rules contained in normative instruction nº 77 from Brazilian´s Department of Business Register and Integration (instrução normativa nº 77 do Departamento de Registro Empresarial e Integração artigo 6º a e seguintes - DREI), 6th article and following articles.
The document appointing the legal representative shall be apostilled, under the terms of the Hague Convention, or legalized at the Brazilian Foreign Service, have a notarized translation and be registered with the Registry of Deeds and Documents - RTD.
Documents shall be presented at least 30 days before the intended start of operations in Brazil, except for the copy of the filing with the Registry of Commerce, and Airline registration in the Guarantee Fund for Length of Service - FGTS, which may be presented during the analysis.
In the case of requests for alteration of authorization which has already been issued, the minimum period of 30 days shall also be applied.
If there are changes in documentation after authorization has been issued, the airline shall submit updated documents to ANAC, by filling in the form merely with airline’s identification and data which has changed, unless differently is provided on regulation.
Documents must be presented digitally through anac’s electronic system SEI. Documents for operational authorization may be presented to ANAC for the necessary advanced analysis while the Commercial Registration is in progress, which may be useful to shorten time for the granting of the authorization.
